Terms & Conditions

1. Organizer

The organizer of the offered travel services is:

Exoria FZCO (IFZA), Dubai, United Arab Emirates, is the contractual partner of the customer and is responsible for the proper organization of the offered travel services.

​

Exoria operates under the brand “Exoria – a brand of Exotravel".


The use of this brand is for marketing purposes only and does not constitute a separate legal entity or additional liability.

2. Conclusion of Contract

By making a booking, the customer offers Exoria the conclusion of a travel contract in a binding manner.

​

The contract becomes effective only upon written booking confirmation by Exoria.

​

By concluding the contract, the customer accepts these Terms and Conditions as binding.

​

The travel contract is concluded exclusively with Exoria FZCO (IFZA), even if the travel services are marketed under the brand “Exoria – a brand of Exotravel”.

3. Subject of Contract and Services

Exoria remains responsible for proper organization and coordination of contracted services, determined by:

  • the respective travel description

  • supplementary information on the website

  • the booking confirmation

 

Where multiple services are combined, Exoria provides a package travel within the meaning of applicable legal provisions.

Individual services are carried out by carefully selected, independent local service providers (DMCs, hotels, transport providers, guides).

​

These service providers act independently and not as agents or representatives of Exoria, to the extent permitted by law.

​

All services are marketed under the brand “Exoria – a brand of Exotravel”, without creating a separate contractual relationship.

4. Prices and Payment Terms

All prices are per person unless otherwise stated.

​

Any registration (confirmation) must be accompanied by the payment of a deposit representing 50% of the total trip price.

​

The balance is due no later than 30 days before departure. Any significant delay in the payment of the balance may be considered as a cancellation by the customer, in which case the cancellation fees described in our Cancellation & Flexibility Policy will apply.

5. Booking Conditions

Prior to departure, the customer is responsible for ensuring they meet all entry and travel requirements, including:

  • a passport with sufficient validity for the destination

  • any required entry or transit visas

  • recommended or mandatory vaccinations and health requirements

  • adequate travel insurance (see Section 22)

 

Exoria may provide general guidance but cannot assume responsibility if these requirements are not met.

6. Minimum Participants & Guaranteed Departures

Some tours operate only when a minimum number of participants is reached. This minimum will be communicated at the time of booking.

If the minimum is not met, Exoria may cancel the departure under Section 9. Guaranteed departures, where applicable, will be clearly indicated and proceed regardless of group size.

7. Cancellation by the Customer

8. Changes and Rebookings

Changes or rebookings are only possible subject to availability and operational feasibility. Exoria may charge a reasonable administrative fee. There is no entitlement to rebooking.

 

In addition, the customer may transfer their booking to another traveler up to 7 days prior to departure, provided all travel requirements are met. The conditions for such transfers are set out in our Cancellation & Flexibility Policy.

9. Cancellation by Exoria

Exoria may withdraw from the contract prior to departure if:

  • the minimum number of participants is not reached

  • unavoidable and extraordinary circumstances occur (see Section 19 and the Cancellation & Flexibility Policy for a detailed list)

 

In such cases, the customer will be offered the choice between a full refund of all monies paid or transferring the booking to a future departure, as described in our Cancellation & Flexibility Policy.

 

Further claims are excluded unless caused by intent or gross negligence.

10. Changes to Services

Non-material changes are permitted. The itinerary may be adjusted due to:

  • weather conditions

  • safety considerations

  • local circumstances

  • governmental or regulatory requirements

 

Where material changes become necessary, the customer’s rights and Exoria’s obligations are set out in our Cancellation & Flexibility Policy, which includes a detailed list of qualifying circumstances.

11. Liability

Exoria is liable within the framework of applicable legal provisions for the proper organization of the travel services.

​

Liability is limited to damages resulting from a culpable breach of organizational duties.

12. Limitation of Liability

To the extent permitted by law, Exoria’s liability is limited to three times the travel price.

 

Excluded (to the extent permitted by law):

  • indirect damages

  • consequential damages

  • loss of profit

 

This limitation does not apply to:

  • injury to life, body, or health

  • mandatory statutory liability

13. Third-Party Services

Exoria assumes no liability for services not included in the booked travel package and booked separately by the customer (e.g., international flights).

14. Duty to Cooperate

The customer is obliged to:

  • report any defects without undue delay

  • allow Exoria the opportunity to remedy the situation

  • review travel documents for accuracy

 

Failure to do so may result in reduced or forfeited claims.

15. Participation Requirements and Personal Responsibility

Our tours are suitable for travelers with a generally good level of health and mobility. The physical activity level is considered light to moderate.

 

Participants should feel comfortable with:

  • walking for short to moderate distances on uneven surfaces

  • occasional stairs, inclines, or unpaved paths

  • getting in and out of boats or vehicles without assistance

  • warm and humid tropical conditions

  • carrying their own daypack or personal belongings during activities

  • participating in optional outdoor activities such as kayaking, snorkelling, light trekking, or cycling

 

No advanced fitness level or technical experience is required. The itinerary is designed to be accessible for most travelers with a reasonable level of mobility and basic physical fitness.

 

Please note that some destinations may involve limited infrastructure, remote locations, or changing weather conditions, which can occasionally make certain activities more physically demanding than expected.

 

The customer acknowledges that participation is at their own risk within the limits of applicable law, and that increased physical or psychological demands may arise during the journey.

16. Health Disclosure (Mandatory)

The customer must disclose all relevant personal information prior to travel, including:

  • allergies and food intolerances

  • medical conditions

  • physical or psychological limitations

  • conditions affecting participation in activities

 

Failure to disclose such information may result in exclusion of liability to the extent permitted by law.

17. Participant Conduct

The customer agrees to behave responsibly.

​

In particular:

  • The consumption, possession, or distribution of illegal drugs is strictly prohibited

  • Failure to follow safety instructions is prohibited

  • Endangering other participants is prohibited

 

In case of violation:

  • immediate exclusion from the tour

  • no refund

  • possible reporting to local authorities

18. Wildlife and Environmental Protection

To protect nature and wildlife:

  • Approaching wild animals is prohibited unless explicitly permitted

  • Feeding, touching, or disturbing wildlife is strictly forbidden

  • Instructions from guides must be strictly followed

 

Violations may result in exclusion without refund.

19. Force Majeure

Exoria is not liable for disruptions caused by unavoidable and extraordinary circumstances. Such circumstances include, but are not limited to:

  • extreme weather conditions, such as typhoons, flooding, landslides, storms, high waves, wildfires, or drought

  • natural disasters

  • political unrest, security risks, or government-imposed restrictions

  • epidemics, pandemics, or public health emergencies

  • strikes, transport disruptions, or delays

  • last-minute changes to flight, ferry, or ground transport schedules or connections

  • closures of national parks, attractions, roads, ports, or trekking routes

  • safety decisions made by local authorities, boat captains, guides, or partner companies

  • unforeseen technical issues involving vehicles, boats, or accommodations

  • sudden restrictions imposed by local communities or environmental protection authorities

  • weather or safety conditions that make activities such as boat trips, snorkelling, kayaking, or trekking unsafe

  • any other circumstances beyond the reasonable control of Exoria

 

Exoria may adjust or terminate the contract accordingly. The customer’s remedies in such cases are described in our Cancellation & Flexibility Policy.

20. Adventure and Activity Programs

Activities such as:

  • trekking 

  • kayaking 

  • snorkeling/diving 

  • jungle stays 

involve inherent risks.

​

The customer acknowledges:

  • participation is voluntary 

  • risks cannot be completely eliminated 

  • safety instructions are binding

21. Boat Tours and Liveaboards

Additional conditions apply:

  • the captain’s decisions are binding 

  • routes may be changed at any time 

  • medical care may be limited 

 

The customer confirms:

  • ability to swim 

  • medical fitness

22. Insurance

The following insurance is strongly recommended:

  • travel cancellation insurance 

  • international health insurance (including repatriation) 

  • trip interruption insurance

23. Data Protection

Personal data is processed solely for the purpose of fulfilling the contract and in accordance with applicable data protection laws.

24. Applicable Law

The laws of the United Arab Emirates shall apply.

​

Mandatory consumer protection provisions of the customer’s country of residence remain unaffected.

25. Dispute Resolution / Jurisdiction

To the extent permitted by law:

  • disputes shall be settled by arbitration 

  • place of jurisdiction: Dubai

26. Limitation Period

Statutory limitation periods apply.

27. Severability Clause

If any provision is invalid, the remaining provisions shall remain unaffected.

28. Written Form

Amendments and supplements must be made in writing.
